Premature Baby: Maternity Pay, Neonatal Leave and Extra Support in 2026/27
A premature birth doesn't change the start date of Statutory Maternity Pay, but Statutory Neonatal Care Pay can add extra paid leave if your baby is in hospital. How the two interact in 2026/27.
Quick answer
A premature birth doesn't reduce your total maternity pay entitlement β but it does mean leave typically starts on the actual birth date rather than a planned later start date, and if your baby needs hospital neonatal care, Statutory Neonatal Care Pay can add up to 12 extra weeks of paid leave on top of the normal maternity, paternity or adoption entitlement.

If a baby is born before the mother's planned maternity leave start date, leave and Statutory Maternity Pay generally begin automatically from the day after the birth. The overall structure β 90% of average weekly earnings for the first 6 weeks, then the statutory weekly rate (or 90% of average earnings if that's lower) for up to 33 further weeks, within a total 52-week leave entitlement β stays the same; only the calendar start date shifts earlier.
Statutory Neonatal Care Pay: the genuinely new entitlement
Introduced to support parents of babies needing hospital care after birth, Statutory Neonatal Care Pay provides up to 12 additional weeks of paid leave (at the same statutory weekly rate as other family-related statutory pay) if the baby is admitted for neonatal care for a continuous period of at least 7 days, with that care starting within the first 28 days of life. This is genuinely additional to β not a replacement for β existing maternity, paternity, shared parental or adoption leave and pay.

Unlike some family leave entitlements that are shared between parents, each eligible parent can access their own Statutory Neonatal Care Leave and Pay entitlement, allowing both parents to take extra time around a lengthy hospital stay without simply eating into shared parental leave allowance.
Tax treatment
Statutory Neonatal Care Pay, like Statutory Maternity Pay, Paternity Pay and Adoption Pay, is taxable income processed through the employer's normal PAYE payroll β Income Tax and National Insurance are deducted in the usual way, and it counts as earnings for means-tested benefit calculations where relevant.
Bottom line
If your baby is born prematurely, don't assume your maternity pay entitlement has been reduced β check the neonatal care leave entitlement separately if your baby needs an extended hospital stay, since it's a genuinely additional benefit easy to overlook during an already stressful time.

Frequently asked questions
Does a premature birth change when Statutory Maternity Pay starts?
Maternity leave and pay generally start on the day the baby is actually born if birth happens before the date you'd planned to start leave β so a premature birth typically brings the start date forward to the birth date itself, rather than the pay period being shortened.
What is Statutory Neonatal Care Pay?
Statutory Neonatal Care Pay is a separate entitlement providing up to 12 additional weeks of paid leave if your baby needs neonatal care in hospital for a continuous period of at least 7 days, starting within the baby's first 28 days of life β designed to add extra paid time on top of standard maternity, paternity or adoption leave, not replace it.
Can both parents claim Neonatal Care Pay?
Yes β each eligible parent can claim their own entitlement to Statutory Neonatal Care Leave and Pay, in addition to whatever maternity, paternity, shared parental or adoption leave and pay they're separately entitled to.
Is Statutory Neonatal Care Pay taxable?
Yes β like Statutory Maternity Pay and other statutory family-related pay, it is taxable income, subject to Income Tax and National Insurance in the normal way through PAYE.
Does a premature birth affect the total amount of Statutory Maternity Pay received?
No β the total statutory entitlement (90% of average weekly earnings for the first 6 weeks, then the statutory weekly rate or 90% if lower for up to 33 further weeks) is the same regardless of when in the pregnancy the baby is born, though the effective start date moves to the actual birth date if it's earlier than planned.
